1. Services Provided

iDesign.Market is a Software-as-a-Service (SaaS) platform for project management, procurement, and related workflows for the AEC industry. The Services are provided via the web and/or mobile applications.

We may enhance, update, or modify the Services at any time. Some features may be released in beta and could change or be discontinued without notice.

2. Account Registration

• You must provide accurate, complete, and current information when registering.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity under your account.
• If you suspect unauthorized access, you must notify us immediately.

3. Subscription, Billing & Renewal

• Access to the Services requires a paid subscription unless otherwise agreed in writing.
• Fees are charged on a monthly, quarterly, or annual basis as per your selected plan.
• Subscriptions auto-renew unless cancelled before the renewal date.
• All payments are non-refundable except as required by law or under our refund policy.
• Prices are subject to change with prior notice.

4. Permitted Use

You may use the Services only for your internal business purposes.

You may not:

• resell, lease, or sublicense the Services;
• attempt to reverse engineer, decompile, or copy the software;
• use the Services to process unlawful, harmful, or infringing content;
• interfere with the proper operation, security, or performance of the Services.

5. Data & Privacy

• You retain ownership of all data you upload.
• By using the Services, you grant us a limited license to process and store your data solely to provide the Services.
• We will maintain industry-standard security measures to protect your data.
• Our Privacy Policy explains how we collect and use your information.

6. Availability & Support

• We aim for high availability but do not guarantee uninterrupted or error-free service.
• Scheduled maintenance may cause temporary downtime.
• Basic support is available via email at support@idesign.market. Premium support plans may be offered separately.

7. Intellectual Property

• All software, designs, and technology used to provide the Services are owned by iDesign.Market.
• Except for the limited right to use the Services during your subscription, no rights are granted to you.
• "iDesign.Market" and associated marks are trademarks of Tech Designworks Pvt. Ltd.

8. Suspension & Termination

We may suspend or terminate your access if you:

• breach these Terms;
• fail to pay subscription fees;
• engage in abusive or unlawful use.

You may terminate your subscription at any time, but fees already paid will not be refunded.

9. Disclaimers

• The Services are provided "as is" and "as available."
• We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
• We do not guarantee uninterrupted service, data accuracy, or error-free operation.

10. Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the subscription fees paid by you in the 12 months preceding the claim.
• We are not liable for indirect, incidental, consequential, or punitive damages (e.g., loss of data, profits, or business).

11. Indemnification

You agree to indemnify and hold iDesign.Market harmless from claims, damages, or expenses arising from:

• your use of the Services;
• your breach of these Terms;
• content or data you upload or process through the Services.

12. Governing Law & Jurisdiction

• These Terms are governed by the laws of India.
• Any disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
